    Court action by two former crew members of "Loon" against the former captain.

    The two former crew members identified as Natalia Niznik and Klara Holubova sustained several injuries. Niznik identified as the individual who was ejected from the tender and was subsequently flown to Miami for hospitalization. "As a result, the pair are pursuing damages in excess of $100,000, citing expense of hospitalization, medical expenses, nursing care and treatment, loss of earnings, impairment of earning capacity and working ability, as well as "mental and psychological trauma".

    I am not sure and would be poorly guessing at this but I would think employment benefits (medical), then Loom (corp and/or owner) would be first in the line of expenses/pain recovery.
    Then go after the captain including punitive.
    From what I'm reading, The captain should still be in jail down there. I am at a loss why not???

    The captain (ex) does not have that money, Loom does.

    Update
    Seems the captain also owned the management company in charge of Loon at the time of incident. He and/or this company just may have some money.

    Loom owner is protected because of corporate protections.

    The boat Loon, Still could be a pawn piece later on.

    My 2 cents:
    Loon owner paid them off and took care of them, signed agreements not to sue, and or made whole by insurance/owner.

    Captain who was responsible (allegedly) and had the management company for the vessel is additionally liable.

    When you are employed by a vessel under and LLC or your own management company, they can go after you. Good reason to be an employee of the vessel and not a subcontractor.

    PS- The Captain has some deep pockets, done very well for himself.

    I can’t imagine the medical expenses not being paid by the boat owner/vessel insurance.

    saw a video from the MAM * channel claiming the captain left the helm shortly before the accident which is as reckless as it gets. And as we know he refused the sobriety test…
