Dear Gentlemen, i seek your advice here. My client is looking to hire a crew for 37 meter Tri-Deck. The boat is supposed to be moored in FLORIDA. One of the demands at least for the captain and the first mate is fluent Spanish. What you would suggest? Any reliable agency down there? Any ideas will be very much appreciated.
Actually we did not decide on the flag yet, as my client wants to buy this boat, and it's unlikely he keeps the existing Malta flag. The boat is still in EU now.
Well, the flag is going to influence the crew, whether US flagged or otherwise. While we haven't used them directly for crew, we have for other things and have had good service from Luxury Yacht Group / luxyachts.
Lux yachts and Bluewater are both excellent, not saying the others are not, just those are the ones I deal with. Good thing you are changing the Malta Flag, it would be a major hassle in the US as you can not get a cruising permit.
The flag really depends on the owners personal situation and preferences. With FL sales tax capped at $300k taxable value, there are now fewer incentive to foreign flag a boat. It s something the owner need to discuss with attoneys and accountants
Aha! I see, so the maximum amount of Sales Tax in Florida will be $18,000. Good! But do you know if the boat is imported from Europe, should one pay the Duty+Sales Tax? Or just the Duty?
None of us can say what is best for the owner as we don't know their situation or future plans for the boat. We've chosen to flag US since we live here and most of our boating is here. Initial costs are somewhat balanced. US, you have duty and sales tax, but foreign you have the annual issue of cruising permit and leaving the US, if not a normal part of your cruising routine plus you have the expenses involved in flagging elsewhere. Long range, the main difference in costs is the cost of crew. As a US flagged vessel, the crew is subject to all US employment laws and taxes. On a foreign vessel, less expensive crew may be found and payroll taxes avoided. That influences the decision of some.
US taxes pay for US Coast Guard, US navigation aids, US port improvements, etc. Seems like a bargain to me.
