    yup that's what I saw also. He has some issues. He is lucky he didn't fall overboard.

    We're all lucky no lives lost and no one seriously injured. Obviously these are just the two times he's been caught. No telling how many times he's done it. That is something I have zero tolerance for.

    Very true, if he is going to get that wasted just stay home and pass out in your own backyard. Or just keep the boat moored dockside.

    Similarly but not the same. A little easier the first time you refuse a breathalyzer and a little stricter on community service. Car requires probable cause to search, boat doesn't. Different field tests. Also for boating, a boat can operate without a driver so the definition of operate was expanded to include the person at the helm, if anyone, but also the person in charge of the vessel, controlling it in total. Like most B and DUI's, it's rather lenient on the first, but tough on future. Also, a little easier to get a client off for an attorney.

    I'm wondering what the insurance/loss coverage implication is when impairment is involved. It appears that this vessel was operated in some level of charter operations. There is a website for the boat that I saw linked on another site. Note the Whaler tender capsized in the surf behind the boat.

    WTH is wrong with people. Why can't someone just hire a Captain. What are you doing coming in Palm Beach inlet at 2:15am? etc. etc.....

    I wonder if he passed out, and nobody was even actually at the helm? How far is the inlet from where the boat went aground?

    BTW, he was tested for alcohol at 7AM and tested twice over the legal limit.....almost 5 hours after the incident occurred.

    He asked how far the inlet was from the grounding. The inlet is a few hundred yards north.
